H-1b: Years of Experience
I am currently doing a 12-months internship (until Nov 2010) on J-1 visa in the US. My company now wants to sponsor an H-1B for me, so that I can be regularly employed after my internship is over.
The job opening requires "2+ years of progressive experience".
my experience is as follows:
6 months (part-time) student assistant (while pursuing degree)
5 months (full-time) internship (while pursuing degree)
3 months (part-time) research assistant
12 months (full-time) internship (in Nov 2010. same company that wants to sponsor H-1B)
Summed up, this is more than two years. But does USCIS also consider it the same way? What about the term "progressive"?
I am mostly concerned because I have 9 months of part-time work and 12 months training internship within the same company that want to sponsor me.
Do these facts have any affect on the way USCIS calculates my years of experience?
Another thing is, that the job opening requires at least a Bachelor degree. My non-US degree was evaluated a equivalent to US-Bachelor plus 1 year of graduate studies. Can maybe this additional educational year count towards the required experience years?
Thanks a lot.

This is something you and your prospective employer need to work out with their immigration lawyer.
