Can Teen Change from Out of Status if Dad's Marriage 1 Day Before His 18th Birthday
lets say a dad and his kid came to the united states as tourists, they overstayed, and now are out of status. the kid is 17 years old and will be 18 by june 30. the kid's dad met a cuban girl who is a legal resident and wants to get married. assuming they get married on june 29th, will the kid be able to change his status along with his dad through marriage? and if so, does he have to get out of the country?

You mean, after your step-mother naturalizes, while you're still under 21? It's possible for a citizen step-parent to file an I-130 for a step-child, as long as the child is under the age of 18 at the time the step-parent/step-child relationship was created; but until your status is adjusted you have no protection from deportation and you will accrue unlawful presence if you stay in the U.S. after you turn 18.

well, i mean, you know how if you immigrate to united states through inspection, the only way to change your status is through marriage. i understand that but lets say that parent(out of status one) has a kid that is 7 years old, i know that the kid can change his status too once the parent gets married to a legal resident because after filing the papers the kid is still under 18. but i wonder if it would still be the same if the kid turns 18 right after the marriage. with papers in progress or maybe not. but marriage did happen before his 18th birthday (assuming one day before)
