Can I get a divorce without wife signing
I have been married to my wife since aug '91. We have gone back and forth in our marriage. In '00 I tried to get a divorce before going overseas to Korea. She didn't sign and I was told later I didn't meet the residency requirements. When I came back I tried it again in '02/'03 while stationed in Georgia. She didn't sign or send anything back again stating concent or not. My lawyer at the time said I had to go to Louisiana and sue her for divorce. My question is I live in Ga. and have tried more than once to move on with my life. What can I do so I can move on with my life? I don't have alot of money to be going back and forth and state to state to regain my legal freedom. Is their any help for me here in my state? :( :?
Divorce in State of Residence
Assuming no children....
Once you have established legal residency, you should be able to obtain a divorce in your state of residence.
However, if you lived in a different state while married, your state court probably won't have jurisdiction over property issues or spousal support unless your spouse consents to its jurisdiction.
Divorce in State of Residence
We were married in Louisiana but never lived together in that state. Because I was in the military the only places we lived together were in Missouri and overseas in Germany. Other than that most of the time she was at home with her mother. I lived in Colorado, Kentucky, Korea and now Georgia. We seperated under a mutual agreement in Jan '99. Since then she has been dragging her feet on either getting a lawyer herself, signing the papers I send or saying she doesn't have the money to do anything. Can I proceed without her concent after 5 years of not having physical contact and me trying legally to get a divorce from her? Not many women want to date a married man and I want and need to get my life back.
