Once charges are initiated, the victim can express a preference but the decision as to whether or not to proceed with the prosecution is up to the prosecutor.
In my case, I am trying to work directly with walmart offering them unpaid restitution(cleaning bathrooms, parking lots etc.) along with twice the reimbursement of what the law requires.
