Name Changed Illegally by Mother
My question involves name change laws in the State of: Oklahoma
Shortly after my wifes birth her mother "changed her name". Until she was about 20 she had no idea of this. She does not have a copy of a legal birth certificate and she was able to get her original drivers license somehow with a bogus birth certificate. Additionally she has a Social Security Number in her "new name". We need to get her a real birth certificate and her name corrected legally so that we can get her Drivers License updated in florida (new federal real id act) as well as get her a passport. Please help. (her mother wont help with anything):wallbang:

if she has a birth certificate with her current name on it, what makes you believe it is not her real birth certificate? How do you know the name change was not legitimate?

It is a novelty birth certificate with a Dr.'s signature and feet prints. And when I say novelty I mean novelty (very whimsical), something you might frame and put on a wall from the early 70's. Additionally when I went to enroll in the Marines when I was 20 they called her while I was processing and demanded to know who she was, and proceeded to tell her that she didn't exist. (This is when we found out that everything her mother had told her was B.S.)

she does know her birth name, the hospital name etc., we previously called the hospital and were advised that they could not find record of her birth on that date. Her older sisters have all verified the hospital is correct. And as for the date, well we are 90% certain that is correct.

Alrighty then... who did they tell her that she was? Who did they tell her had a driver's license and Social Security number under her "real" name, if not her?

She was either born there or she wasn't. If she knows the name she was given at birth, quite obviously that would be the name she would give them.

You're stating that you're only 90% sure of your wife's date of birth? You think her mom magically changed that on her birth certificate, as well? Nobody in her family can help her out with that, either?

Just for fun, have you tried to obtain a birth certificate from the state based on the information on the "novelty birth certificate"?
Wouldn't it be a hoot to find out that she really is who she has lived as all these years?

this sounds very much like what my brother recieved (actually my mother for my brother) from the hospital he was born in. It was not an official legal document but it did contain all the proper info.

and you have never known the military to make a mistake? How did you resolve the problem at that point?

We have tried to obtain a birth certificate based on the info on the fake one.
I am sure that it is fake because i was born at the same hospital that she has been told she was three months earlier and obviously in the same state. Additionally my two children were born there. All of us have identical looking birth certificates except my wife. we are 90% sure of the date because, her mother is VERY mental and has had a very shady past (constantly lies, alcoholic who has switched her addiction to oxycontin (sp) etc) I could go on but suffice it to say the womans credibility is nil. As I stated the military tipped her/us off to the fact that something was off. When that happened she was oblivious as to anything being wrong other than her birth certificate was odd. This stuff all happened pre 9/11 , patriot act, etc. the fact that she was able to get a DL or SSN with the birth certificate was a miracle. (I was also just informed that the signature of the Dr.'s name on the fake cert. was forged by her mother)
As for how the issue with the military was resolved, she was told that they could find no record of who she was or that she existed (tax jokes were abound at the time) and that she would not be allowed to travel as my wife etc.
All in all we have been dealing with this for years on and off and We have come to the point that this has to be resolved now.

I find it hard to believe the military simply let it drop after that. There are way too many reasons they would need to know if you had a wife or not and if she doesn't exist, she could not be your wife.
Oh dang, you might not even be married!!!
here's a really obscure thought:
she was kidnapped as a baby. Her "mother" isn't really her mother. Her entire existence as she understands it is all a lie.
Sounds like she is going to have to due some sleuthing and asking relatives and family friends for information. Until such time the government requires DNA samples at birth, they simply cannot tell you who you are if you don't already know.
