seems to me as he hurt himself. as well as the witnesses thought the same thing. but i could press charges as well? neck is scratched. arm is sprained.
Its like saying he broke his knuckles for hitting my arm. but instead its his shoulder.
he hit me as well though... just not in the face?
i could basically press charges on him. because he hit me.

Actually...yes, in many ways that's exactly what it means. You NEVER have the right to put your hands on another person unless in self defense.
(Which is precisely what your friend is going to claim, by the way - he was defending himself against you)

You don't seem to understand this.
The first one to throw a punch in anger loses. You were the first to touch the other.
You have, by far, the larger burden in your defense.
It is entirely appropriate that you face charges.

Ask yourself this:
Who threw the first punch? You. You were the aggressor.
Who defended himself against the person who threw the first punch? Him.
Fact is, from what you have stated: YOU threw the first punch. YOU are guilty of Assault and Battery.
Oh...add to it..."He has had previous surgeries on this area several times to my knowledge.". In other words - you knew certain movements would cause him further injury and pain.
You may want to get that temper under control. A case in Michigan - two teens, just like you and the guy you punched. In the Michigan case - the victim was punched, hit the floor, sustained serious head injury. Spent years in a coma. When he died - as a result of that punch...guess what happened to the aggressor? That old assault charge was upgraded to a MURDER charge.

i didn't throw a punch. i gave him a one handed push to the chest. He threw the first punch.
BUT QUICK QUESTION
he said his family isn't pressing charges?
but the police automatically press charges or something?
what's the deal with that or is that even true
