    Can My Ex and I File Bankruptcy Together
    My question pertains to the state of Illinois.

    Am I able to file for Ch 7 with my ex husband?

    Also how will that impact my husband? I just remarried in December of last year .
    My husband and I have NO debt together yet both of our tax refunds were taken due to my ex's and my debt on an old home.

    My ex husband and I had A LOT of debt together. 3 years ago we had a very messy divorce. Now we cannot get back afloat, and my tax refund was taken this year to pay for the balance on our foreclosed house.

    I have been in contact w/ the mortgage company multiple times in those years and they have not been able to tell me anything about my account and how much was still owed on this property that was foreclosed on. :wallbang:
    (I filed an injured spouse form today.)
    I just don't want to have to drag my husband though all of this and have it negatively impact him.

    You're divorced, living apart and... remarried. No, you will need to file separately.
