Collections Action for Rent By Former Landlord
This is for the State of Arizona
I was renting an apartment in 08' in for 7 months. I wasn't on a lease, it was month to month. I paid rent every 1st of the month, but when I gave them a 30 day notice it was on the 15th of that month. So the notice had until the 15th of next month on there. I was actually moving out of town on the 3rd of the next month. So when the 1st came back around I told the landlord when i was actually moving and she told me just to pay her up until the 3rd, so I did. On the 3rd I gave her all of my keys and caught my flight the same day. Well, almost a year later a collection agency calls me saying that i owed a debt at my last apartment for 400 dollars. I asked him for what charges, and he said "oh just misc. charges" like it was no big deal that i should just pay it and get it over it. I asked him why hasn't anyone contacted me sooner before putting this on my credit. And he couldn't really answer me, but still insisted that I paid to get it over with. I told him i wanted to dispute it because i would like a print out of everything i was getting charged for. He wouldn't do it! So i'm like i need to call the apartment complex about this, so i called and there was a new manager there from when i was there, so she was giving me an attitude as if i was bothering her!. And she couldn't really explain to me, but she said it was for unpaid rent. And i'm like oh noooo, i have All of my receipts but she was still giving me an attitude, and wasn't trying to hear me. I told her that i wasn't in a lease, because thats how she was talking as if I broke a contract or something. And she just blew me off and said i'll you back after i talk to the corporate office. And hung up on me. Both the apartment management and collection agency are difficult and I can't even FIND the "corporate office" she was talking about.:wallbang: I'm so lost, i dont know what to do next! Because i've moved to a completely different state and noone is cooperating with me! Now, that i am trying to find a new place to live, the landlords are telling me that there is an "unpaid rent" under my rental check as if I got evicted or something! Which is far from the truth since I have the copy of the 30 day! and all of my receipts! I called the apartment complex again and she rudely told me "you didn't give us the keys" and hung up! Which is another lie! This is getting ridiculous! Can they do this? Please help!:(

I would expect a collections action for $400 to be listed on your credit report. Look and see. If it is, and it's not accurate, dispute the entry.

if disputing whats on your credit report fails to work.since you have moved out of state.the burden of proof is on you.make copies of your proof for both credit agency and the new manager.if they still dont budge.have the attorney general of that state handle it.you can usually fill out a form with them on your complaints ,as noted.

It's definitely on there, I disputed it. After I disputed it, collection agency faxed me "the proof". It has 400 dollars "misc. charges", then splits up $100 for cleaning, and $300 for unpaid rent, I can agree on the cleaning, but the unpaid rent, completely false. I have my intent to vacate, and last month rent receipt with the words "last payment" on it. So what could they be talking about? I never missed a payment, i have all of my receipts. I told the collection agency this, they told me not to bother to send them because its already on my credit report? huh? is that true?? Apartment comp. not cooperating, acting like its out of their hands. Can i send them to Experian? When they investigate, do they ask them to show proof that the debt is valid. Or do they just ask them for a simple copy of the bill? Basically like the shallow "bill" that they faxed me. It still wasn't a complete itemized statement, no dates or anything.
