Trial by Written Declaration - It Has Been 5 Months, What's Next
My question involves traffic court in the State of: CA, at the Los Angeles Metropolitan Courthouse.
I filed TBD along with the bail in October 2009, after requesting a bail extension. After checking the status on the LASC website, it now says this:
Court: Metropolitan Courthouse
1945 South Hill Street, Los Angeles, CA 90007
(213) 742-1884
Violation Date: 02/15/2009
Initial Due Date: 04/02/2009
Case Status: Court
Disposition: 10/26/2009
Last Action: Court trial
Last Action/
New Appearance Date: 04/23/2010 in 067
This citation is not eligible for any online transaction.
I think 10/26/2009 is the date when they deposited my check. Five months passed now and still I have not received any response from the court. I tried calling the court, hoping that I can speak to an operator about the case status, but obviously they recently decided not to provide live operators any more due to "severe budget cuts". I wasted almost half an hour with the machine before I finally gave up. :wallbang:
Can someone interpret my status? Did I win/lose the TBD?
Any idea how soon I should be expecting a response from the court in the mail?

There was a disposition on 10/26/2009. If you lost, that would explain why there's another action scheduled on your file, as presumably you haven't paid. But we are also in the position of having to guess.

My friend is actually the TBD clerk at Metro. Please send me a PM and I will give you a number where you can speak to someone directly. LASC has shut down their traffic information phone center.

Thanks guys for the help. I was really surprised when I found out that there was no way to reach a live operator to ask questions about the case. I mean, California is richer than most of the countries in the world (with a GDP similar to that of Italy), and it now can't afford a traffic information center to its residents?
Re: Trial by Written Declaration - It Has Been 5 Months, What's Next
The Los Angeles Superior Court laid off 329 employees March 16, with their termination date being effective April 1. This is the first of many waves of layoffs, another 500 are scheduled to be let go just after summer (September). If still they don't get under the deficit, there are another 500 scheduled to go. They are shooting for 1800 people losing their jobs.
If you think the court are doing bad NOW, talk to me in about a month when the masses get larger and my coworkers grow tired.

Thanks for helping all on here CourtClerk, it is appreciated.
I would like to request the same number if I may PM you for it as I am in a very similar position. I filed my TBD with Aisha (maybe you know her) January 12th,2010 and I just checked my ticket status today (April 26th,2010), and this is what it says:
Court Law Enforcement Agency Violation Date Status
Metropolitan Courthouse Los Angeles Police Department 11/02/2009 Court
I realize that a sovereign citizen waives the right to speedy trial by submitting TBD, but I defer to you and your expertise to let me know if over 3 months at this point is cause for calling in despite the massive personnel layoffs and dismantling of the phone system at Metro.
From the 'Court' under 'Status' description it appears it has not been ruled on yet, but I already had an FTA placed on my driving status by the Court (that i was forced to rectify) due to their negligence in processing my paperwork and bail for TBD (not complaining to you, just explaining that I'm concerned about further negligence on the Court's behalf reflecting on my record instead of the Court.)
Please let me know your thoughts when you are free to do so,
Thanks!

Yah, thanks TG- I read it before I wrote to CC. If you read what I wrote, I am asking CC for the number IF he/she wishes to provide me with PM contact info OR a response /advice. I am merely using the resources made available through this forum put out there by such experienced individuals like CC and yourself.
Re: Trial by Written Declaration - It Has Been 5 Months, What's Next
I think what TG was trying to say (and I appreciate him for reinforcing it for me :D) is that I read these forums pretty regularly and I specifically said
Quote:
So, if I see something that rings a bell with your situation, I will prompt YOU to PM me.
Some of you don't realize, Metropolitan court is the LARGEST traffic court in the nation rumor has it. It processes tickets for their courthouse and 5 others in the City of LA and within its boundaries. There is going to be a delay - in some cases, of several months. There are going to be mistakes, I'm sure none of you go to work and do a perfect job every day.
If you realize in the original post (or maybe you don't realize it), the OP posted his problem of nonresolution to his ticket more than a year after he got the ticket and 5 months after he submitted his paperwork. Even in my opinion, that's ridiculous (talk about patience).
If in a couple of months you still haven't heard anything, update the thread. I'll see it.
Re: Trial by Written Declaration - It Has Been 5 Months, What's Next
I realize it said what you pasted in bold, and thanks for responding. That is why I asked for any
"contact info OR a response /advice".
I was throwing it out there to see what you were willing to provide, and you gave me a reply with your last statement
"If in a couple of months you still haven't heard anything, update the thread. I'll see it."
which completely satisfies me for the record. :)
And trust me, I realize the scale of L.A. Court system. it is NOT a rumor. The pinnacle of inefficient beauracracy will result from pulling funding and manpower from the largest city in the nation with the highest population.
It may not be wise to advertise yourself as having an inside line to help through a system that has otherwise failed the taxpayer, EVEN IF you post a whole thread( which I also saw and read before posting here) telling people to lay off badgering(paraphrasing) you for help. I think its silly to not expect the masses to at least ask for some kind of wisdom when you make such a claim. But like I said in my initial address to you, your help on 'expertlaw' is very appreciated, so please be patient with those who are in a hurry, as well as those who take the time to address you comprehensively and diplomatically!
Anyway, you answered my question sufficiently, so Thank You very much, and if in a couple of months I haven't heard anything I will update this thread.
THANKS AGAIN!!:D
