Shoplifting - 484a and 490.5
My question involves criminal law for the state of: California
Hi,
We had this bad experience on last saturday. My wife stole good worth $110 from Target, California. Since it is above the certain limit, Target security has to call the police and the cop gave her a citation with 484a and 490.5 with misdaemor charges. I was not there in target at the time of incident. When I went there, I spoke to the security officer and pleaded him not to call the cops and was willing to pay any fine that they want. But the security officer politely refused it. Security in Target told me that she was caught in the camera and gave the video tape to the cop.
I am on H1-B visa and my wife is on H4 visa. My employer is willing to process GC and the process has been started. And also my H1-B renewal is in process.
My wife will completing her pre-requisites for nursing. This is the first time she did the shoplifting.
I have the following doubts,
1) How are her chances of getting admitted to Nursing school if she has this incident on her history?
2) Can she write the Nursing Certification if she has this in her history?
3) Can she get the nursing certiciation ? (She will be writing her certification exam after 3 years provided she first gets admitted to the nursing school)
4) How will this effect my H1-B renewal?
5) Will we have a problem in GC Processing?
6) We are willing to do what ever the court will ask us to do but we just don't want this to be in her record as I am thinking it will ruin her chance of becoming a RN. What are the different outcomes we may get and based on those outcomes, what should be our future course.
7) Can someone suggest a good lawyer in victorville, california area?
Last 1 week has been a nightmare for us. We are considering moving back to India if she can't join nursing scool or if she can't do the nursing certification.
Thanks in Advance,

The best advice I can give you is to get a Criminal Defense Attorney. And you may want to speak with an Immigration lawyer, as well.
No one here can suggest a lawyer - grab the Yellow Pages or go to www.yellowpages.com and start looking up lawyers. Many will offer free initial consultations, others will charge a small fee. So go in with your questions ready. You can interview different lawyers until you find one that you feel will work best with you.
