Caught Shoplifting - What Do I Do
My question involves criminal law for state of: New York
I was recently caught on camera taking items out of their packages at a retail store and putting them in my pocket. I was approached by one of the employees and interrogated. I was taken into a back room where they priced the stuff to a little over $100. They did not call the police but rather told me I had 48-hours to come back and pay for the items. I never left the store with them (they are still there). So, my question is at this point, now that I am no longer in the store, do they have any recourse? Can they still call the police on me? Before leaving I provided my driver license and basic info. Please advise!
Just to add... The employee shoved me (relatively lightly) twice. Is that legal? I never made any motion towards the door, nor did I attempt to leave with the items. I do not have any money and would prefer not to go to my family for the money. Just to reiterate, although I removed some of the items from their packaging, they are ALL still in the store. Do you think they would actually go through with calling the police at this point? And more importantly, can they still press charges? Thanks

Go to the store and pay the money immediately. If no charges are filed, consider yourself DAMNED lucky.
Wanna know what it could cost you? Ever read those signs in WalMart and other stores that say shopping can cost you $2000? They are NOT kidding.
Civil Demand: Atleast double the amount, sometimes more.
Criminal Charges:
- Court costs and fines. Atleast $300.
- Lawyer or Public Defender, if you qualify for P.D....add in more money. Costs vary. P.D. in MI is $250.
- Probation, Anti-Shoplifting Classes...if sentenced to these also...guess what...not free.
Add to it: Permanent Criminal History.
If I were you...that $100 payment on your items looks like a nice deal, huh? Just remember...they won't be that nice next time....and they will have a file with your name on it with all their evidence...

i have a question for anyone who may know, i was areested, or rather cited and had my rights read to me, they let me go with the ticket and i now have a court date. the base fine says tbd. which i think means to be dated. i am 25 and have not been in trouble with the law since i was 18 when i was cited for theft 3 as is the situation now, will this have any affect on my case? will i need a lawyer to stay out of jail? what will me consiquences for this mess be? are there any actions i can take before the court date to help smooth this over or make it less intense? i was thinking of calling the court in portland and trying to have my previous record expunged. any thoughts would help.

TBD likely means TO BE DETERMINED.
It is possible your old record will be brought up in court.
A Criminal Defense Lawyer is a good idea, especially as you do have that older record.
