Suspended Imposition of Sentence
My question involves criminal records for the state of: Missouri and Utah
Background: I received a SIS in the state of Missouri for DWI 3 years ago. I have finished my 2 years court supervised probation. I would like to get a CCW permit from the state of Utah.
From what I can gather, Utah says the applicant can't have a conviction of an alcohol related offense within 10 years. I am of the understanding that with my SIS there was no conviction and the record was sealed. I would think that this means I am able to get the permit from Utah. Is this the case?
Any help or point in the right direction would be greatly appreciated.
Thanks.
Re: Suspended Imposition of Sentence
If the law specified convictions only, and doesn't treat a suspended imposition of sentence as a conviction for purposes of the statute, it follows that you don't have a conviction for purposes of the statute. You can look up the statutes here.
Re: Suspended Imposition of Sentence
Thanks for your reply!
The wording of the law (to my knowledge) and the form to fill out specifically says convictions. I guess, weither or not it treats the suspended imposition of sentence as a conviction is the real question I have.
Also, forgive my ignorance, but what would I look up on the page you linked?
