Third Degree Theft in Hawaii
My question involves criminal law for the state of: Hawaii
I have a friend who was house-sitting a house for a friend he knew a few months ago. He sold a WII to gamestop and is now facing these charges. He offered to pay for it back the day the family came back but they went all crazy and called the cops. He was watching the house with there permission. This is his first offense. What are the chances of him going to jail?
He did sign a confession for the police about selling the stuff to gamestop. He alway stated that he was willing to pay for the lost property.
Always which is wrost, 1st degree 2nd or 3rd degree theft.

1st degree is worst. What exactly is he charged with?
It doesn't matter that your friend offered to pay for it after he was caught. Many thieves make that same offer.
He will likely have to pay fines and court costs. Maybe community service, probation.

In Hawaii shoplifting is a petty misdemeanor, as long as the theft is $100 or less. The maximum penalty is $1,000. 1st and 2nd degree thefts are classified as felonies.
