    Engaged to an Illegal Immigrant
I am a US citizen and my fiance came across the boarder uninspected 6 yrs ago. He has no criminal record- only traffic violations (driving w/o license). I have several specific questions I have not seen anyone ask before:
    1. If I marry him in the US- do I need to worry about his lack of filing taxes since he has been here?
    2. Everyone talks about being apart because of the 10yr ban (that is if it happens)- but I can chose to live with him down in his country for that period of time while we get papers filed/straightened away, can't I?
    3. He is a professional boxer here in the US- can his trainer/promoter sponser him? Can my family sponser him?
    4. We have been engaged now for almost a year and are still debating whether it would be better for us to get married in his country or here in the US- Can you give me some advantages/disadvantages for either?
Thank you for your help in advance.[/i]

    Mr. Knowitall
If he leaves the country he can apply for a waiver of the bar, but there is no guarantee that he would get a waiver. Even if you and he move to his nation of origin and wait out the bar, that doesn't guarantee that he will be permitted reentry after the period expires - just that he will again be eligible to apply for a visa.

It would be wise to consult an immigration lawyer.
