Second Possession Charge in Michigan
My question involves criminal law for the state of: Michigan
About 1 1/2 years ago I was caught with less that a gram of marijuana, charged for marijuana transport, sentenced to and completed 6 months of probation and was never mentioned to anything about the 7411 law.
I recently was pulled over in another district (in the same county in MI) with a dime of weed and charged with marijuana possession and later learned of a 7411 law.
The way I understand what I was taught about this law is that I am most likely going to spend time in jail from this sentence.
I was wondering if that was true and what the likely sentence may be from anyone out there with experience with this crime in this *cough* great *cough* state of Michigan.
Any help or information would be greatly appreciated as I cannot afford a defense attorney.
Re: Second Possession Charge in Michigan
The more crimes you commit, the more severe the punishment is likely to be.
Sentencing practices can vary widely by county. In Wayne County, they probably don't have room for you in the jail. In some northern counties, they have plenty of room for offenders who would get probation in other parts of the state, and judges are happy to fill that space.
