    Immigration Issues After Petit Larceny
    My question involves criminal law for the state of: new York

    I was arrested last year in November 2009 an I stole from Duane reade. Stole $35 worth of stuff. When I was in the store I never signed a paper claiming that I admitted towards stealing anything. I have a court date coming up on march 15. My main concern is that I'm a documented illegal immgrant. I had a work authorization card when I was younger but it expired in 2004. I spoke to a criminal lawyer and he said that an acd would be in my best Interest. When I did get detained, I was never taken to central bookings. I was given a DAT and that was it.

    I spoke to an immigration lawyer as well and he said that there is a possibility that the govt might try to detain me and also try to deport me. My question is how likey is it that this can happen? I've never gotten in trouble before and I'm also a college student. My record is completely clean. Both my parents are also illegal but my sister is a us citizen. Also my aunt sponserd my family for their green card and we will have an interview for it in January 2011.

    If I do get the acd and not get detained what are the chances of this effecting me getting my greencard?

    Is the government even aware, at this point, that you're undocumented?

    The offense should fall under the petty offense exception to crimes of moral turpitude, so as not to prevent your eligibility for permanent residency, assuming you aren't deported before that time for unlawful presence.
