    Can I Drink on a No-Drink Probation
    My question involves criminal law for the state of: minnesota

    I was recently convicted of 2nd degree assault with a firearm in the state of minnesota, and the judge ordered me a no-drink for the duration of my jail term and seven-year probation. now comes the tricky part; i am getting married this summer, and i wanted to know if i am legally able to consume alcohol if it is on private property owned by my family. any help anyone could give me would be great. thanks

    If you have been banned from drinking, you have been banned. Anywhere.

    Keep in mind that the state does not have to have a breath test. You drink at a public event and if there is just one person who does not like you and turns you in, you will likely be arrested for violation of probation and have a probation revocation hearing. Obviously alcohol was involved in your offense, so you are really taking a big risk. I can understand the whole wedding thing, but a honeymoon in jail is not going to be fun.

    Here in Key West a jeweler got probation for DUI - alcohol - for hitting several young people on scooters. He was busted for possession of mj and had his probation revoked and got the whol sentence, 12 years, in prison.
    Although you are just starting your probation, keep in mind that there is no such thing as counting the time served on probation if you are revoked. It means nothing.

    Enjoy your wedding. Stay away from weapons and alcohol. You obviously are not responsible enough to handle either and both would be probation violations.

    Also, realize that you would be starting your way down a slippery slop. If you justify drinking for your wedding and get away with it, you will start justifying it for other things and before you know it, you will be doing 7 years or more in state prison.

    No drink means no drink. There's no special loophole for "at my wedding on my family's property". It really does mean No, None, and Nowhere.

    If you have been banned by drinking, it does not matter whose property you're on. The judge ordered that you not consume alcohol, and if you were caught doing so, it could result in consequences from your probation officer. Plus, the fact that you were ordered by a judge not to drink makes me think you're likely a recovering alcoholic, in which case drinking once could lead to drinking again, and again, and so on........ ultimately resulting in a relapse.

    Dude, this thread is almost 8 years dead. Check dates before replying to things please.
