Statute of limitations on theft by rental

Guys any help here would be grateful,10 years ago in Alabama I was buying a flute for my kid on payments they said was rental but what ever anyway I went to jail in Feb. 1996 drug bust the kicked in the door and you know the rest ,anyway while I was in jail my exhusband
went to my home and collected my valuables and my kids stuff I told him he needed to make the payments on her flute he was ok with that well when I got out of jail I collected what he had taken for safe keepings and I ask about the instrument he said he took care of it so I heard nothing of of it till today they called said they was gonna file charges theft by rental now has been 10 years can they do that?

thank you,I had hoped not cause my exhusband is now dead and I dont have a clue where that flute is I was even thinking I would just pay anyway but the guy was so rude even cursed and attempted what we call strong arm collections throwing around threats one of which was pay me now or in 15 minutes I am gonna press charges on you for retal theft ,I mean i never had any idea of cheating him I was paying him paid alot on it now he even wants more than was
paying 10 years ago.
