    False Harassment Acusation
    My question involves criminal law for the state of: NY

    Long sotry short:

    My ex-wife has been calling, emailing, leaving voicemails, yelling at me when picking up the kids constantly since I left her. Last week she crossed a line and called my job and threatened to kill me on my voicemail. I pressed harassment charges.

    A week later I was arrested in her home town while picking up the children. This charge is completely bogus, I record every conversation I have with her and on the day in question every phone call on both her phone record and my phone record are accounted for. On top of that, the day she claims I was harassing her, she called my house 4 times in a row screaming at me, leaving 2 messages on my voicemail after I stopped answering.

    How do I go about filing a "filing of a false police report charge", do I need to wait until after I am found not guilty? Also along with the harassment charge, what kind of trouble can she get in and is it possible for me to make her pay my legal fees / lost time at work for these proceedings?

    Work with your criminal defense lawyer to dispute the charge against you. If you are cleared, the prosecutor should have a pretty good idea by the end of the case as to whether she filed a false police report. You should not expect her to pay your attorney fees or lost wages.
