Passenger Had Marijuana, but Summons Was Issued to the Driver
My question involves criminal law for the state of: LOUISIANA
MY 17 YEAR OLD SON GAVE A RIDE TO ONE OF HIS FRIENDS,THEY STOPPED AT ANOTHER FRIENDS HOUSE AND AS THEY WERE GETTING OUT OF HIS TRUCK A POLICE OFFICER STOPPED HIS FRIEND PANICKED AND HE THE 15 YR OLD HAD A BAG OF WEED AND DECIDED TO THROW IT IN MY SONS TRUCK. THE 15 YEAR OLD ADMITTED TO THE POLICE THAT IT WAS HIS BUT THEY ONLY SUMMONS MY 17 YR OLD WITH POSSESSION AND DID NOTHING TO THE 15YR OLD. WHY? NOW MY SON IS SUSPENDED FROM BASEBALL, WHICH HE HAD SCOUTS GOING WATCH HIM PITCH THIS WEEKEND AND WILL PROB. END UP HAVING THIS ON HIS RECORD.IF THE 15 YR OLD ADMITTED THIS WHY CHARGE MY SON?????

Presumably because either they didn't believe the passenger's story, or because they concluded that your son and the 15-year-old both knew about and intended to smoke the marijuana. We can only guess. Your son's lawyer can read the police report, and will probably get a pretty good idea from the report.
