My question involves personal finance in the State of: Texas
My identity was stolen in October 2009. I found out about the theft when I started receiving payment books and credit cards in the mail that I had not opened. I immediately took all the steps that were required of me. I contacted the Credit Reporting agencies, FTC, filed a police report, and placed a fraud alert on my credit file
Experian and Transunion removed the accounts and inquiries from my credit bureau report. However, Equifax has not removed a $9k account that was not opened by me and keep stating they have verified that the account belongs to me, even though the business's fraud department has confirmed the fraud and claims they have notified Equifax several times to remove the account. I did not take the business's word for it, and mailed Equifax a letter stating that my identity had been stolen. I provided them a copy of my police report with the investigating officers name and phone number.
I have called Equifax and they told me to call CSC Consumer services, since they manage credit files in my area. The number they referred me to never has live operators to talk to anyone directly. Is there legal action I can take.
I've kept a log of every conversation with the different bureaus, companies and the investigator as well as copies of the letters I've sent. I want to know if I should take legal action at this point or is there something else I can do? I know I've written Equifax 3 times, and all to the same result. The same account was removed by the other credit bureaus as a fraudulent account.

You can complain to the FTC, but they don't resolve individual complaints.
If you can't get anywhere without litigating, then your remaining option is to litigate. See the FCRA.
