International Travel With a Conditional Green Card
I currently have a conditional green card, it expires May 2011. I know I have to apply to have the conditions taken off 90 days before. However, I need to go back to my home country for family reasons, I am unsure of how long this will take. My husband will be staying here in the States. How long can I be out of the country, before it will not be deemed I have abandoned my permanant residency.

    Thank you for your time

i think you are allowed to be out of the US for 4 month out of the year
but i'm not %100 sure so you might want to double check that.

In simple terms.... The most significant dates are six months and one year, but the USCIS can determine abandonment of permanent residency based upon an absence shorter than six months. If you're out of the country for less than six months, although you may be asked to explain what you were doing, if you remain married with a permanent home in the U.S. and explain the family crisis it probably won't be a big deal. Six months to a year, assuming your family crisis lasts that long, you should be able to reenter but should expect to be questioned about whether you did in fact maintain permanent U.S. residency, with the USCIS making a final determination. For a year or more, get a reentry permit before traveling.
