    Citizenship Application, N400 - Can't Find Records
    was arrested in NY back in 2000. I have the certificate of disposition but NY is taking way too long to send me the arrest record, honestly I don't know if they even have it.
    Also, I can not find the certificate of completion of a drunk driving program which i had to assist to.
    Should I send my n400 application without these documents? if that is not a good idea what can I do ?

    You're trying to get the arrest record from the police agency involved? Have you tried placing a call? Unfortunately, we can't help you with expediting a record request from an unknown police agency.

    In terms of the "certificate of completion of a drunk driving program", you never filed the certificate with the sentencing court? Then you may have violated the terms of your plea deal or probation. If you did file it, there should be a copy in the court file. You may also be able to obtain a copy from the program itself.

    Yes, I requested the arrest record from the proper police agency. I received a notification stating that they have received the request but it is a delay of 240 days.. yes 240 days! I have call them but there is no "live" assistance from the records division. I live in a different state now. I guess i will have to travel to NY if I want to get it earlier than 8 months.

    I requested the disposition from NY, I got it, but there was no prove of completion. I know I completed it because that is one of the requisites for motor vehicles to end the conditional license. I have been trying to get in contact with the program office with no luck...

    I visited an immigration office today and ask an officer in regards these documents, she told me that I HAVE to have ALL the documentation, and this two are very important. So there is my answer.. I HAVE TO in somehow GET this documents.

    My good friend has the same problem as you, it's been 20 years when petty theft happened, now she is applying for citizenship and do not have any documents to support it. According to the court, it was not on the database anymore. She is worried that if she files for her naturalization, she will be denied.

    When my husband was applying to adjust his status, he had a similar issue with a >10-year-old conviction for drunk in public and one for DUI being expunged from the records. He had a certified document from the court saying that no records were found on him, and stated truthfully on his application that he had these prior convictions but that the records were no longer available from the court.

    You can't provide what is no longer available.

    In the case of the original poster, if there is a deadline on the application (for citizenship, I don't think there is), then I would file the application, and include the written response from the court and your own explanation. If there is no deadline on the application, and I couldn't get the documents for 8 months, then I would wait the 8 months before applying.
