Public Drunkeness and Disorderlly Conduct Charge
My question involves criminal law for the state of: pennsylvania
I went to a show with family and friends. I had a designated driver(usually I am the designated driver). I ended up drinking too much. We all went back to my house and kept drinking, playing yahtzee. By about 0430 everyone had enough and went to sleep ,except for my niece and I.We work night shift. My niece decided she wanted to leave and I made a terrible decision and walked her home. Its about 3 blocks. We just had a major snowstorm and some of the walks weren't cleared off so we walked on the side of the street. On the way back to my house,I slipped on the ice . I hit my head in a snow bank and broke my glasses. Ended up pretty banged up. I tried several times to get up but couldn't. S the police found me lying in the road. They helped me up, an ambulance was called. I gave the police all my info, I didn't have my ID with me. The ambulance was there and I didn't want to go to the ER(I WORK THERE) I remember arguing with them about going . Some of this is foggy. I remember being handcuffed and brought to jail.I spent the next 5 hours in jail . My daughter picked me up. She told me that the police told her that i was rude and belligerent. they said they were going to charge me with Public Drunkeness and Disorderlly Conduct. Also my BAC was in the highest level.
I am very embarrassed by this and have had my name and circumstances published in our local paper. I have embarrassed and hurt my children. I got my paperwork and have a charge of Public drunkeness and Disorderly Conduct #5503 S4, gradeM3, misdeamenor b, limited. This is my first offense. I work as an RN. My questions are: what can I expect to happen as far as what I will be convicted with? Is this a criminal charge? do you think I could get the charges lowered or 'diverted"? How will this effect my record and my employment. I have worked there for 19 years and am respected by my peers.
I'm not trying to make excuses but I have been through some very stressful and lifechanging things in the last year. Because of this I have been in counseling and have started to take meds . I know I need to get a lawyer, but does it make a lot of difference if I get a public defender or hire a lawyer? Money is short, since I have been left in bankruptcy. By the way, I'm not drinking anymore. Please help.

If this is a first offense you probably have a very good chance of getting a diversion.
Call your county's diversion office through the district court or look on their website, and you might be able to find a diverson application, or instructions how to apply or guidelines about who usually qualifies. If you can't figure out things on your own, a quick initial phone consultation with a local lawyer might put you on the right track.Good luck and take care.
Disorderly conduct is a criminal charge, but likely won't involve doing any jail time--likely a fine and a misdemeanor conviction on your record if you aren't acquitted. Once you complete a diversion, the charges will show up as dropped.
