If My Ex-Remarries, Can She Change Our Children's Names

My question involves a child custody case from the State of: Illinois

If my ex wife gets remarried can she change our children last name to that of the man she is marrying? I don't want her to be able to it would just confuse our children when they have always had my last name not to mention my children with my second wife also have my name. Will my ex wife be able to do this without asking me?

She cannot change the names of your children without your consent unless your parental rights have been terminate.

Then no, she cannot change their names without your consent - unless she is able to get the courts to allow the name change.

Update:

I put in a motion to stop my ex wife from moving out of the county with our children and to prevent her from atemping to change our childrens last name to that of her soon to be husband. The hearing is on the 22nd of this month. She says the only reason he wants her to move to where he is from is because he doesn't want her to live in low income apartment anymore and while I have no problem with him helping her to get out of a low income apartment. I do have a problem with her moving to another county with our children, especialy when she has broken visitation orders repeatly just because she was mad, with her living that far away it would make it easier for her to do so again. And there is no doubt that he would help her do so especialy when he just posted this online a few days ago ( i wish nick would just freakin die he lies and nobody likes him what a loser ). I don't want to lose out on any more time with our children than I am already forced to because of the divorce.

I'm not sure if the county thing is going to turn out in your favor. I understand the custodial parent being prevented from moving out of the state, but preventing them from moving out of the county is a little much unless the county they're moving to is outside of the state.

I tend to agree - unless the county is, for example, at the other end of the state (it could mean a looooong drive!) from Dad.

My ex wife also has no drivers license due to a DUI and she won't be getting it back for another year and on top on that she keeps driving with out one every time you get caught driving with out a license from a DUI you get another 6 months without your license and 10 days in jail. She has already been caught doing that once. So she really has another year and six months untill she gets her driver license back. So she can not do the transportation for visitations. And the guy she is getting married to has no license too. I own my own business and work a full time job so I can't always do the pick up and my ex will not allow my wife to do it. And has stated in court that she will not let my wife pick up the kids, and she tried to get my wife banned from the visitation exchanges but the judge would not allow it. Not to mention that I am a member as is my wife of my son's school PTA and we are both very much involved in all school events where as my ex never goes, with the expection of the school christmas program. Our children are very used to having both me and my wife at all school events and field trips and we wouldn't be able to do that as much if she were to move out of the county.

Well our court date is in just a few hours I will update when I get back from court
