Can a G4 Visa Holder Get a Green Card Through Marriage
I came here with my father 13 years ago on a G4 visa. My Work permit expired in the year 2004. I got a HS diploma and an A.A.S. here. I met a US citizen who I love and who loves me to. We got a baby together. He wants get married to give me a Green card. My questions are:
Do I have to go back to my country and come back before I get my GC; eventhough I got a baby who was born here ?
If yes, how long does the whole process take ?
Is there any other way ( long or short ) that I can a it other than through marriage to a US citizen ?
If yes, what are the procedures and how long does it take ?
Do I also have to go back home before I get the GC ?

No. Since you entered legally, and simply overstayed, you may adjust your status after marriage by filing an I-485 and an I-130. It would take about a year for your green card to be processed and sent to you.

You could go back home and apply for a legitimate work visa and attempt to qualify for a green card through employment. However, since you overstayed for so long, you'd be denied entry to the US for ten years. You would not be able to come back until the expiration of the ban.
