I Was Left a House As a Minor
My question involves real estate located in the State of: Texas
My grandmother died in 1995. Before she died she sold her house, she allowed me to pick another house. she told me that it she was buying it for me. The house was put in my name and my mothers name, as I was was only 15 years old at the time. I do not know if she had a will or trust set up before she died as is was very suddenly after we purchased the new house. I am now 29 and my mother and I have lived here ever since.
She has taken out two mortgages on the house to buy her self cars and to pay off her now ex husbands credit card debits. I have never received any part of the loans. The bottom line is that we keep having problems. I want to take ownership of my house, or sell it. We basically cant get along, and I am dealing with my fathers suicide. I have never tried to take ownership or even talk about it, but her lack of compassion is affecting my mental state and I feel it would be best for both of us to part ways.
So my question is how do I prove it was left to me.
Am I stuck with the situation until the mortgages are paid off?
Thanks
Re: I Was Left a House As a Minor
If the house was purchased and placed in both your and your mother's name (as joint tenants? with a right of survivorship?) that would normally create joint ownership, not sole ownership by you.
How was the money borrowed without your consent? Or did you consent to the mortgages? Are you named as a mortgagor?
