Will My Criminal Record Affect My Citizenship Application
Hi,
My citizenship interview is on March 1, 2010. (applied Sep, 2009) - no attorney hired.
I obtained Green Card on March 14, 2004.
I have criminal record (Unlawful use of identification - allowed to use my ID to someone for gaining access to casino - resulted in pleaded in guilty - $200 fine and 1 yr court supervision - Misdemeanor Class A (under Illinois) - it was April 14, 2004.
I listed everything on my N400 application.
How does it affect to the chance to get citizenship? I am worried about it.
Also, How I prepare the interview? Do I need something to show that I am a good person since that happening? also, Does interviewer ask specific question about that happening?
Thank you in advance.
Re: Will My Criminal Record Affect My Citizenship Application
With the maximum penalty for your crime being a year in jail (as opposed to less than a year), and the possibility that this is going to be classified as a crime involving moral turpitude, I suggest consulting an immigration lawyer.
By "allowed to use my ID to someone for gaining access to casino" do you mean that you gave your ID to somebody else to use at the casino? Did they then commit criminal acts while using your ID? You are referring to 15 ILCS 335/14?
Re: Will My Criminal Record Affect My Citizenship Application
Yes, It was 15 ILCS 355/14. This crime actually is punishable less than 1 year. Look at 730 ILCS 5/5 4.5 55. Does it mean that removal proceeding is not applicable, right?
