DUI Probation Violation in Michigan
My question involves criminal law for the state of: Michigan
Last year, I was driving around Detroit drunk and was pulled over. I plead down to impaired driving and put on one year probation.
Well, my probation is supposed to be up, but I just got a notice in the mail saying I missed three breathalyzers dating back to March of 2008 and I have to show up to court. By the time I go to court, my probation would have been up already, and I've paid all my fines and attended all the classes I was supposed to.
It was a miscommunication between me and the probation officer, as she says she didn't give me the color, and I know she did (which was the wrong color, which I found out after I went to the breathalyzer place to figure out what the heck went wrong).
With it being so far into my probation, and the violation happened so long ago, is it possible the judge will just resume my probation?
Re: DUI Probation Violation in Michigan
You aren't discharged from probation until the court discharges you. If you have a pending violation at the time your probation is "over", the probation violation hearing can proceed.
Did you mean March, 2009?
It's quite possible, if the probation officer didn't make an issue of this "back then" and you've fully complied since last March, that the probation officer intends to recommend a discharge.
