I was arrested in California:
I was arrested with 232 grams of Marijuana, which is a FELONY amount.
I had $365 on me and the police saw "circumstancial"(no specific words or anything necessarily incriminating" text messages on my phone and then told me that i was Intending to sell Marijuana and was told i will be taken to jail for Possession with Intent to Sell
I was booked and put in Felony Lockup at the Main Jail.
I was then released on my Own Recognizance. When being releasesd i was handed my 853.6 PC which is my Notice to Appear in court.
On it my charge is listed as HS 11357(B) - Possession less than 28.5 Grams.
Which is a Misdemeanor charge.... So im not being charged with a Felony???
What does this mean? Cause i was arrested with more than 28.5gs. does that mean im being charged for less? or is the District Attorney gonna receive the Police Report and change it to something else?
Am i not being charged with Intent to Sell? or is that gonna be added on later?
And does this mean that i should just show up at my court case and plead guilty to the Misdemeanor and be happy that i got lucky.
Yes the Police knew that it was over 28.5 cause it was all weighed out back at the police station before i was sent to the Main Jail.
