I was recently at a party of about 65 people in Lawrence, Kansas. My phone was ringing and the party was too loud so I grabbed my friends jacket, which had a beer in the pocket, because of the cold temperatures and stepped outside to answer it. Outside there was 5-6 kids drinking alcoholic beverages, not to mention the 2 other kids that exited the door the same time as me. There was also a police officer standing outside, and looked at everyone outside. He walked by 5 kids all holding beers to get to me. He let all the other kids go back inside and proceeded to put me into handcuffs. The officers didn't even attempt to pursue the various kids who were jumpin over the patio railing and sprinting down the street. He told everyone that was under 21 to leave their beer and find a sober ride home. When I heard the officer say this, I pointed out my sober ride hom which was literally parked 20 feet away. He said "No, you're staying with me, take a seat right there". He sat me down and then let all the other kids (most of whom were severly intoxicated) go without any warning or ticket, he simply told them to find a sober ride home. I was not being disruptive or causing any kind of ruckus, had no prior run-in's with this police officer yet he seemed to have some kind of personal vandetta against me. He kept me in cuffs for about 20 minutes and gave me an MIP. I was the only person at the party to get any kind of infraction. Do I have any legal basis to challenge this MIP charge? Should I plead guilty or not guilty? I want to do something about this because it was extremely unfair and I felt like it was very unethical.
