Malicious Wounding , Robbery , Gang Participation
My question involves criminal law for the state of:
Virginia
Hi i am being charged for malicious wounding , robbery , gang participation. a guy got into a 1 on 1 fight while i was there and got his nose broken and somebody stole his $5 necklace. the police are saying that once he was on the ground i started kicking him and i was asking him for money and that i was yelling out gang phrases. My lawyer talked to the victim and she told me that the victim said that i didnt ask him for money and that i wasnt the one that stole his necklace and hit him and that he dosnt remember anyone yelling out gang phrases he said the only thing i did was ask if he was a member of ms-13. they are trying to commit me and i am only 15. and i am scared as whats going to happen. i am on probation for larceny and i have no violations that is the only thing on my criminal record. all these charges happend last july and they are bringing them up and charging me almost a year later. most laywers who have heard the case said it should get dismissed. but does anyone have any opinions or advice

Yeah...
You already have a felony and are looking at a series at 15.
Statistically, unless you straighten your life up, you won't live to see 21. I am not judging you... just telling your chances.
I would do the same if I walked by and saw you spinning the cylinder in a pistol and putting the gun to your head.
The odds are against you.
Listen to your attorney... and straighten your life up while you still can.

the larceny isn't a felony it was under $200 . and it will be dismissed in December if i continue my probation with no violations

Do you believe that malicious wounding, robbery and gang participation would be a violation?
Okay, so the larceny isn't a felony. Great... that means you still have the opportunity to walk away from it.
If you get convicted of ANY of the charges or even a lesser charge, your dismissal is toast.

they told me that since the robbery indecent happened in July and i got put on probation in December that it wouldn't be a violation
