Drainfield Easement Problems
Hi,
The person who originally built the home we are in also bought the next door lot and put his homes drain-field there in 1979. Didn't grant himself easement??
We purchased both pieces also - did not survey - no septic easement listed on either title. Septic tank on house property.
10 years later due to cash problems - we moved our home property line 100' into our undeveloped lot to keep drain-field on, and sold the remainder to neighbor. About 2 years ago, neighbor gave/sold property to child who built home along with septic/well
Now we find out after surveys done by another neighbor last year our property line is off 88 ft with our drain field on the neighbors property

So, basically, you're stating that you messed up when you set the new property line, and despite the 100' expansion of your lot you're still encroaching on the new lot by 88'? Is this preventing your neighbors from setting up their own septic system?
