Splitting when You Can't Afford to
Utah: My husband is not working and has not for almost 8 months. Alcohol is a huge problem. How do I separate when there is no money to do so? If I file for legal separation and he remains at the house am I responsible to support him? I don't want to leave our home because I am the one paying the bills. He has lost his license again and is facing his 5th DUI charge. He has no car or DL. I feel like we are stuck together because of the circumstances. Do I have a legal way to get him out of our house or will he have to remain in the home because he has no "means of support" at this time? Thanks for your help. His other DUI charges are 17+ years old so he will be treated as a first time offender here in Utah.

You can file for divorce and try to convince a court to give you exclusive possession of the marital home. I can't promise that the court will do that.
