    Can a Mother Lose Custody if She Leaves Her Child With Family for Four Months
    My question involves a child custody case from the State of: NY/NC

    My brother (in NY) has partial custody of his daughter, who currently lives with her mother in NC. We just found out that my niece was left with her uncle while her mother will be gone for 4 to 6 mths.

    Can my brother get custody or at least have my niece the whole time the mother is gone because she did not notify my brother that she was leaving his daughter with her brother.

    Mind you, as far as we know her brother does not currently have a job.

    Brother has what custody rights under the court's custody order?

    Mother is going away for what reason?

    If brother wants custody, brother would benefit from getting a job and demonstrating that he can offer a suitable, stable household for the child.
