I-130 Deportation
Good morning/afternoon all,
My I-130 was recently sent to a local office in NY. I have been married with my wife for 2 years (dated her for almost 6 years). She is a US Citizen. I came here legally with my parents when i was 7. My parents case failed causing them to become illegal thus making me illegal and they overstayed (i was only 14 at this time and did not know of any of this). My lawyer advices me I can go to the i-130 interview and they will 99% approve of my marriage after my proof's but they will also arrest me immediately due to my deportation orders and I will have to fight the case from my country (India).
My Question: I hear from different people they cannot arrest you. My lawyer states it is a 90% chance i'll be picked up because of my previous deportation orders. Can anyone confirm any of this? Thanks.
