My question involves paternity law for the State of: TN.

My sister has two twin boys. My sister's boyfriend, kicked her out at Wal-mart at 1:30 AM two weeks ago. My father and I had to pick her up. We then went to the sheriff's department and they told us that we could the get the boys the next morning and they would accompany her. The next morning, we were informed that we needed a court order to retrieve the boys. We went to a lawyer who told us that she had legal right to the boys. My sister's boyfriend has his name on the birth certificate, but no paternal test as far as we know.

My sister told us that his family (whom she lived with) where extremely abusive towards her.

So we were just curious how long would it take before we can expect to receive her sons? And what right's does she have since his name is on the certificate?

I expect that will take as long as it takes for her to file the custody case and to get a court order granting her custody. Isn't that what the lawyer told you?
