Shoplifting Juvenile
My question involves criminal law for the state of: Hawaii.
My 16 yr.old and friend were apprehended at Walmart for shoplifting $50 of merchandise. Walmart held the two for around 2hrs 20 mins. before police could get there. I was not allowed to see my teen.Wal mart is pressing charges.
Did Walmart violate a law by holding the teens for that long? The officer told Walmart "be careful - you are not supposed to hold them for that long".
The teens declined to make a statement for the police. Police said it would go to the prosecuter instead of juvenile division. What happens now?
Must the teen disclose the arrest to current employer if teen does not work for a retailer?
Police staff advised that it would be a long time before the prosecuter would call parents.
Should I get a lawyer? Thank you.

Re: Shoplifting Juvenile
AWWWWWWWWWWWW MAN! I just saw a guy and two employees behind him entering the employee's only section. I guess the guy got caught or something because the two employees looked pissed at Longs today.
Basically, it's no more than 5 hours, so Walmart didn't violate anything.
The teens will get a civil demand letter and it must be paid as soon as possible. If they don't, then you, the parent, will be sued and your credit rating will be affected. When they go to court, they need to plea not guilty and ask for a public defender.
