    DUI and Aggravated Assault Charges in Arizona
    My question involves criminal law for the state of: Arizona


    Hello-
    My Fiancee and I are looking for 2nd opinions about the charges she is facing. After a car accident, She was charged with Aggravated. Assault (Dangerous- other driver with broken arm sadly), Criminal Damage and 3 DUI charges (BAC of 0.162) She hired one of the "top" dui attorneys in town spending all her savings although I personally felt like we should have gonne the Public defender route first . Right after arraignment- a plea was offered of Agg. Assault(Non Dangerous), and Criminal Damage with probation not available on the latter. God Willing, she would get a max of 2 years if given probation on the assault.
    The plea was prepared on a date before the attorney was hired leading me to believe it was the standard plea offer they give to everybody in her situation and naturally, questions arise if we could do better. We both are resigned to her going to prison but whats the norm of plea deals in such a case- n does her blood being drawn after 2 hrs help_ if not, would it be at least a bargaining chip, I have heard the results can still be introduced in court (makes you wonder why the hell did they make the 2 hour limit law in the 1st place!) N oh- the attorney says take the plea

    I have read similar cases in Maricopa County where people were able to plea to a class 6 undesignated felony- n their facts seemed way worse: Although it looks like the plea she was offered is pretty much the standard original plea given to everyone in Arizona- any hope?: she is more scared of the felony convictions that anything else (she is in pharmacy school) and a class 6 would be good in that after completing prison time and probation, it would be come a misdemeanor- if what we have read is true.

    Has anybody here read about or is familiar about how such cases always end in Arizona (Pima County, but I am guessing it should be the same in the whole state)?

    If you believe that a better deal could be negotiated, help your fiancee get a consultation with a different criminal defense lawyer. I expect, though, that a local drunk driving defense expert has a pretty good idea of what deals she is or is not likely to be offered.
