Assault Probation Violation
My question involves criminal law for the state of: MICHIGAN
My daughter who is 20 pled guilty to 2 felony counts of assault on an officer and one felony count of assault with a weapon (brick) against me. She was given a special sentence of probatoin for 3yrs and if successfully completed would not have the felonies on her record. She dropped dirty and was sent to jail for 90 days, she was pregnant and after 4 days she had the baby. She was supposed to go back to jail after the birth but did not. She has been on the run for 4 months now. There is a warrant for her arrest for this and a warrant for unpaid child support. Do you have any idea what her sentence would be for this violation?
Re: Assault Probation Violation
A lot of things can affect her sentence.
Where's the child now? On the run with her?
Re: Assault Probation Violation
No, CPS placed him with me right from the hospital because he tested positive for marijuana and she was supposed to return to jail.
Re: Assault Probation Violation
Well she's likely looking at several years in the state prison system, just for the felony convictions that were placed back on the table when she violated her probation. That's in addition to any NEW charges, contempt of court charges, etc.
