How to Get Out of My Home

My question involves emancipation laws for the State of: of Illinois
Hello my name is Diana, I live in chicago illinois. I am currently 16 years old I just turn in early november. My parents have broken me down mentally physically and emotionally. My life has not been good, I've suffer my whole life of seeing my mom hit, my mom partying not taking care of us neglecting her requirements a normal mother would have, my mom was never there for me when i was little my dad was never home and when he was he was either hitting or yelling at us. On one occasion my father had came from work it was late and me my brother and sister were sleeping on a matress on the floor near the door he went into the room my mother was in and held a gun to her head threatening to shoot her if she had not told him she was cheating we had come in and saved my mom's life, it was very difficult to focus in school having so much problems at home fearing being shot down by my dad while i slept sound in my bed. My parents were very strict and shielded us from the world we were not allowed to go out with friends or do what any normal kid would do be involved in sports or activities it was very lonely and hard to cope when your always alone, my parents always talked about how we were stupid and how we would make nothing of ours lives, i've try to commit sucide due to always being put down and hurt by my parents my dad had found out i had a boyfriend who was of african descent and he had slapped me and that was my breaking point i tried to jump from the window my father had yelled at me later for it and threaten to put me in a mental asylum til i turn 18 the depression i went through living there being socially isolated and having my dad hit me til i turn 13, and being yellled at and put down just made me numb inside, i was also dealing with being rape by my cousin i had told my parents and my dad acted as if it was my fault and basically interitgated me like i was some kid at work that this happend to he had always favored my older sister and hugged my older sister when he heard that she was molested but for me i guess no sympathy please i need help i need out i want to file for emancipation when i turn 17 please please please im begging help me what i have just told you is just a tiny bit of what has happend in my life if you knew all the things ive been through you would understand how much i need out im not one of those ignorant kids just trying to get out so they can live with their 28 year old boyfriend, or just being a brat and wanting to leave their parents home just because they wont let them sleep over some guys house or stay out late please i have real reasons just please help me :( any suggestions would be appreciated thanks to all

"My parents suck and I'm suicidal" are not reasons for emancipation. In fact, claiming that you're suicidal will ensure that you will NOT be emancipated.

Without a full time job, a proven record of taking care of yourself, already living apart from your parents, and a stellar record in school, emancipation is not an option for you. Doubly so if your parents object.

If you're being abused, call CPS. That's your option, period.

that's not my only reasons i know i can take better care of myself and i am looking for a job, and my friend has a place so i could stay there. And um no you dont need a full time job when your going to school you have to prove you are going to futher your schooling and that you can support yourself. Research more dear thanks though =] but i researched myself and i know the requirments sweety

So, you've done your research. You're well aware, then, that you're not a candidate for emancipation, because you're not 100% self sufficient already.

You do understand what 100% self sufficient means, right? Paying your own rent - not living for free under someone else's roof, you actually have to get a lease and pay rent for it to count? Buying your own groceries, paying for your own medical insurance (this is required by the court), have a savings account and a budget all worked out? And your parents - who you say don't allow you do do ANYTHING - are totally cool with this? This is also required by the court. If they say No, it's Game Over, and you don't respawn.

You knew all this already?

Your rudeness is uncalled for and proves that you are nowhere near mature enough to adequately fend for yourself.

You can see the Illinois emancipation laws here. You must be at least sixteen to bring an emancipation petition in Illinois. Among the other facts you must establish to emancipate, you must show to the court's satisfaction that you are "a mature minor who has demonstrated the ability and capacity to manage his own affairs or (ii) a homeless minor who is located in this State; and [that you have] lived wholly or partially independent of [your] parents or guardian."

From what you've said, beyond your age you have no proof of any of the above and thus are not presently going to succeed in a petition for emancipation.

your really mature sweety you see the thing is i have a whole year to do this and sorry sweety but your not even a real lawyer haha your so cute actually you so called researcher you dont even understand throroughly what qualifies hun =] not to mention i can recall i had put in the question that i want to get emancipated in a year i'm getting a job in the summer and i already have money and yeah sweety i'm renting a room in my friends house sorry but you really have no clue read up some more before you reply how about you not take offense so easily and grow up. and yes i read all this you have no idea,m you think you know everything and you don't i've read and studied the amendents honey =] thanks though your so sweet ;)

thanks for your respectable answer =] i am fully aware of the requirements but thanks its nice of you to answer =] its good to look in the amendments for answers to the law. =]

proves how mature you are and sorry sweety no homework but hey fair enough but how about you get a real job as a lawyer =] instead of acting like one teehee just a thought :D

if your parents hit on you and harrass you and threaten you life that much you need to call the athorities and get them away that way. parents should never be that way. if you've been rape you need to call it in and file a report. some of the things you have said can lead to a serious case in court. emancipation from something that bad would catch the judges attention away from the emancipation and say your probably emotionally unstable to emancipate and probably put you at the age of 16 in a adoption.
