Trespass by Neighbor
I think I know the answer, but I'll ask anyway. I recently moved and a package was delivered to my previous address. The package didn't arrive on the day expected, I called FedEx, they had delivered to my previous address, I had forgotten to change the address with the vendor mailing package - my fault. I called new owner to ask if they had received it, no answer. I drove to the house and knocked on the door, while waiting for an answer, I noticed the FedEx box sticking out of the garbage can. The can was not at the curb. I took my package and left. I left a voicemail saying I had received my package, but not wanting to embarrass them, I didn't elaborate on the package in the garbage. Not that I am expecting a problem, but these people are kinda strange, is this trespassing? I mean it's my property, it has my name on it and it was in plain view.

Collecting Package
It may well technically be a trespass, but I doubt that anything would come of it under the circumstances. It's similar in many ways to going onto a neighbor's lawn to collect a ball or frisbee - I'm not aware of any prosecutions in such cases.

thanks, that what I thought too, but in this day and age, you never know. I asked a deputy and he said there isn't a court or lawyer in their right mind that would prosecute that. I looked at Ohio Revised Code and from what I gather, being on property with intent to commit a misdemeanor or felony has to be made, or violating posted signs. I have done neither. I wonder if I would have a case regarding them throwing my package away! But I am willing to let it go, amazing that they threw it away - geez. thanks again for your input.
