Assaulted and How to Press Charges
My question involves criminal law for the state of: MA

Hi all, I would like to know how to go after this person that assaulted my friends and I. It was 3 of us who were beaten to the ground by at least 10-12 guys. The police caught 2 suspects, but they are not my main concern because I don' t know who they all are, except for this one person. I know him and he was one of the lead attackers, I told the officers about him but sadly, I don't know his last name/address, but I know where he lives, so I don't think the officers will take him in.

This person deserves to be in jail and he and the others used beer bottles and chairs and everything in sight when attacking us for no apparent reasons: we did not provoke them in any way...other than being people who did not live in that town. This particular person that I want to press charges upon deserves it...it's a long story and I won't go into it unless you are interested. We were sent to the ER to get treated as well as taking xrays and CAT scans.

How can I press charges on this person? Hire a lawyer? And can you predict what his punishment might be? Thank you.

you said it was unprovoked but then you say there's a long story behind it. All of that will be considered when DA looks to charge them or not.

By long story, I mean of how I knew him. He is a friend of my ex and I have known him for 5 years. When I came into the karaoke bar, he greeted me, called me brother, shared songs with me, and then 10 minutes later lead the attack. This is why I want this particular person. He is the only one of the 12 attackers that I know.

If you know where he lives, tell the police. If he was involved in the attack and they can prove it, then he can get charged.

If you want to sue the guys then you can hire an attorney to sue them for your expenses. If they are convicted of a crime, chances are restitution would be included in any guilty plea or conviction, but that depends on whether or not they have the means to pay it off.

You cannot compel the state to prosecute anyone. You can give the info to the police and let them handle it, you can express your desire to see prosecution to the police and later to the DA, and you can sue them. You cannot compel prosecution.
