Restitution Fund
I have a friend who had his $11,000 brand new motorcycle stolen in Arizona in 2004. The guy who stole it, was caught in Nevada, trying to sell the transmission of the stolen motorcycle. The thief was charged for his crime in Arizona and served his time.
Can my friend file for restitution on this case, being that it is almost 6 years old?

If you're talking about a case that's presently being prosecuted, he may as well try. But it appears that you're talking about a six-year-old prosecution, with the sentence long served, such that the sentencing court would not have jurisdiction to revisit the sentence.

Out of time I am afraid.
1. The sentencing court can do nothing at this point, like ordering restitution.
2. Many states have victim compensation funds, but they generally only cover personal injury. In any case he is out of time.
3. A civil action would be barred by the running of the statute of limitations.
The only possible thing is if the statute of limitations could be tolled by the incarceration, but that is a state law issue and I seriously doubt it.

I am talking about the restitution fund...you know, the fund that is set up for vicitms of crimes, which they can file to be allowed to be entitled to it, because they are a victim of a crime.
