Arrested for Shoplifting in Delaware
My question involves criminal law for the state of: Delaware. I am a tourist visa holder and have been traveling to US for 5 years now. I was arrested for shoplifting items valued at $93.00. Was fingerprinted and taken to the court where I pleaded guilty to the crime and was asked to pay a fine of $156.00 including court fees.I think my charges were dismissed.
1. Will this affect my future visits to the US?
2. My immigration papers for permanent residence under family category has been filled.
3. What does charge dismissed mean. Will I be able to get this expunged?
Re: Arrested for Shoplifting in Delaware
If you plead guilty that means you've been convicted I believe.
Re: Arrested for Shoplifting in Delaware
If you entered a guilty plea, odds are you were convicted - and even if the charge was somehow dismissed following your plea or you obtain an expungement, the USCIS will still regard you as convicted unless your plea was set aside based upon your actual innocence. A shoplifting conviction would disqualify you for the visa waiver program, and can make it more difficult for you to obtain a visa. It will be considered in association with any effort to gain permanent residency or to naturalize.

i think the cop told me it was probation before judgement. Though the judge said that i would be briefed on the case by the clerk while making the payment i was only issued a receipt but nothing about the case. Is there anyway i can get a copy of the court procedings.
