    I got turned down at the Canadian boarder while going to a wedding. I was denied jobs and was given a hard time for a school loan. The only way I can see myself having a decent life is by starting a business. And I'm sure my record will affect that in some way. I know what I did was a mistake. Believe me I know. But I've learned from it. I have a daughter now. My mistake is making it difficult for me to give her a better life. I want this so badly. I hope people realize that this is something that should be offered to people who have committed non violent crimes. We have been rehabilitated, now give us another chance

    On top of that I tried enlisting in the military because I've always wanted to do it and I can't because of it. I don't want to enlist because u feel like its my last resort because its not. I want to enlist for the right reasons. I messed up and it sucks that I feel like I can't have a successful or even decent life

    I totally relate with your circumstances so please lobby for this bill. Speaker Silver and dan Salvin are against it. I have it confirmed. Dan Salvin is lobbying silver that this is a bad idea because then they can't put more crimes in later.

    New York State is one of those rare states that make it very hard to rehabilitate yourself. Unfortunately unless everyone pushes harder it won't go into effect, and this will affect you enormously. The senate has passed the public safety part of the budget so i don't think it will be going into the budget. keep fighting.

    It's unbelievable how one guy is able to block these bills. It's so ironic that out of all the things we were worrying about with the Republicans who ended up not speaking out against them at all, these bills are being held up by a Democrat. It's so ridiculous too because they could easily amend them later to make sure they include more offenses. But instead they let everyone suffer. If they really wanted a bill to include more offenses then why didn't they draft that to begin with? Just another example of more lawmaker fiddling around while Rome burns.

    However we are going to make a last ditch effort to change Silver's and Salvin's minds. So if everyone can please keep calling them today and for the rest of the week. Let them know how important passing Bill # A6065 is to you and how if they couldn't get a bill like this passed this session (with the most ideal conditions we'll ever have), how could they expect it to pass at a later time when it gets more conservative?

    An important update everyone and that's Senator Sampson and Assemblyman Lentol want to hold a special Codes session on bills S1708 and A6065. So it's not over yet!

    However we need everyone to start lobbying... otherwise it will be. So please call the numbers in my previous post above this one right down the line. Assemblyman Silver and Dan Salvin need to be lobbied the hardest because they're the ones blocking it.

    Also since Lentol and Sampson are the legislators still carrying the torch please call them and send donations to their campaigns since that's had the best results for us.

    For Assemblyman Lentol it only has to be for $25. Don't forget to include a note or letter thanking him for sponsoring Bill A6065 and requesting him to revise it and to put it in this year's budget. Try to get them out immediately because they're most effective when everyone sends them in together. They can be sent to:

    I spoke to Dan Salvin yesterday, and it didn't sound like he was being much of a 'blocker' in this. He said that the matter is out of his hands at this point, and that my best bet would be to continue lobbying Assemblyman Lentol, since he is the sponsor, and would be the one responsible for pushing it forward.

    Spoke with Silver's and Salvin's office again, once again voiced concerns that this bill is necessary. Secondly, it appears that Mr. Sampson is still looking to include S1708 in the budget. Please keep the calls coming, and tell Mr. Silver to pass legislation that is wanted via the people of New York, rather than legislation he wants the people to have.

    There is absolutely still hope. It is and i repeat not dead for this session. What occurred was the senate could not give an approx. fiscal impact figure and the assembly was not that energentic on on it.

    But silver is saying he could go as a stand alone so keep pushing.

    Yes there is still hope as long as they're willing to pursue it as a stand-alone bill. Granted it's not as reassuring as if they were putting it in the budget because then it'd be a sure thing. But at least there's some chance this way as well. The other thing that seems somewhat good is that Assemblyman Silver's stance against it appears to be lightening up. So that means our lobbying is working. And when I call Dan Salvin he pretty much plays dumb each time, however he did set us back a bit behind the scenes so it was good we lobbied him.

    But our lobbying efforts will have to remain steady. Because while the budget has to get passed, stand-alone bills they can forget about. And the Sampson/Lentol bills are 2 years old, which means they're no longer good after this session. Then we'd have to get them to start from scratch next session, which doesn't even start till January 2011. So we really want to get these through now.

    To start off on Monday, the first step is to call the two people who sponsored each bill. The bill they wrote is listed next to their name:

    Next and probably the most important is to get a hold of Assemblyman Silver who's been the one killing us on this. However he might finally be willing to compromise at least a little bit. So let him know how imperative passing Bill # A6065 is to you.

    Also it's imperative that you call Assemblyman Silver at the number listed in my last post and his Communication Director (since he gives him messages directly). Request that Silver supports Bill A6065 and that he gets it put to a vote on the Assembly floor.

    If you have any friends or relatives who are willing to help please tell them to call as well. And if you have time then go down the list and call the rest of the important contacts listed above. We're tight on time and it's in our best interest to do this now. We do stand a chance but we can't let them push it off because then it'll be too late. So let's keep reminding them how important it is that New York puts a criminal conviction sealing law into effect!

    Sorry to say the bill dies today. Silver wanted more offenses included, and wants to wait to see if the senate majority increases. Also i must say not enough people lobbied on this board, and i want to thank the few that did.

    Well everyone, that's all she wrote for this session. I want to thank all the people who lobbied as hard as they could. While it offers only little consolation at least you can live with yourself knowing that you did what you could and it's New York State that is insane. To those that could've helped and didn't then you should be ashamed. And now you'll have another year to feel guilty about it while you sit there with a conviction. Next time don't sit around complaining... get involved!

    Anyway, before all of you take a break for the summer please do these three things:

    1. Subscribe to this thread
    2. Turn on the e-mail notification for when you get a private Inbox message
    3. Vote Democrat across the board this November

    The first two are so you're notified if there are any updates or when it's time to start lobbying again. However instead of taking the summer completely off, since these bills will be scrapped now, maybe we can work with the legislators and get the bills they want drafted... so that way when the session starts at the end of December we'll be able to start right off the bat.

    We can find out what exactly Silver wants and relay that to Sampson and Lentol, so that way we can get a bill drafted that they'll actually put to a vote.

    If any of you have any ideas then feel free to chip in. Any questions then don't hesitate to ask me. And in the meantime please recruit as many people as you can over the summer to help lobby next year. Also don't forget to save your letter template because we'll be sending a lot more out again right at the beginning of next session. And if you haven't made one already then please do so, that way you'll be ready!

    Well, it was a good effort. And we've come closer to putting a sealing law in New York into effect than any other time before and a lot of it came down to our efforts. So thanks again, and no matter even if you take the summer off from lobbying, please remember to check back here at the end of December because we'll be at it again!

    She's interested in hearing personal stories from real people. You don't even have to go on record if you don't want to but it'd help if you did. And honestly would you be any worse off than you are now with no sealing bill ever going into effect?

    This is the only way we can get Assemblyman Silver to reconsider his stance on it which is important because this opportunity might not come around again, so even if you want to speak anonymously you should still call and voice your story and opinion on why this is something we need. So sound off!

    She's also looking for a lawyer to comment on what these bills would mean exactly. I know some of you have talked to some so if you know of any and are still in touch please pass her number along to them as well. Thanks!

    I want to add some positive news. I spoke with dan salvin tonight, and he says next year the bill should start much earlier. Deliah from Senator Sampson said the same thing. We has two options up the fee on the motions for sealing so that it can be included in the budget so it has a fiscal impact. Second next year we are not relying on the budget we will push for a stand alone. Dan was optimistic for next year. So please Lentol needs to be more forceful.

    Here is an e-mail I received from the Executive Chamber earlier in the week (it doesn't have to do with our bills but I include it for the reason I'll list below it):


    My Fellow New Yorker:

    I’m working to get our economy back on track, and I need your help. A key piece of legislation that would protect and create hundreds of thousands of jobs in New York State has passed the Senate 59-2, with support from both Republicans and Democrats from Upstate and New York City. The bill would create a permanent economic development program administered by the New York Power Authority (NYPA) called Energize New York that would use one of New York’s great natural resources – low-cost power produced by our hydro power plants – to bring in new jobs and protect existing jobs in our State. Our bi-partisan plan would provide participating businesses with multi-year low-cost power contracts in exchange for commitments of jobs and capital investments.

    Energize New York would replace two recently expired economic development programs - Power for Jobs and the Energy Cost Savings Benefit program. More than 320,000 jobs statewide were supported by those programs, and because we’ve designed Energize New York to be more than 50 percent larger than those programs combined, Energize New York could be capable of supporting 490,000 jobs across the State. This means that not only could Energize New York support existing businesses in the State, but it could also attract new businesses and create tens of thousands of new jobs.

    But the Energize New York plan has not even been introduced in the Assembly, despite remarks made by Speaker Sheldon Silver more than a year ago, when he called for the creation of such a program, saying “Businesses need certainty. I would ask that we allow time in the next session to put a permanent or multi-year solution in place.”

    Instead – and in typical Albany fashion – the Assembly has offered a proposal that sounds good, but cannot be paid for. The Assembly bill would direct NYPA to offer cash-supported discounts to businesses, instead of low-cost power, which would be funded by NYPA revenue; however NYPA’s revenues vary from year to year and cannot be forecasted with a reasonable degree of certainty years into the future. This approach fails to achieve our basic objective, which is to provide businesses with certainty they need to invest in New York and New Yorkers.

    While utilizing this hydropower is exactly how we can create a stable, predictable and sustainable economic development program, it is also why the Assembly refuses to act on our proposal. In 2009, this power provided an average discount of $2 to $4 per month to Upstate residential customers - a benefit the Assembly says is too significant to give up. But in reality, what those same customers would be giving up in lost jobs and lost opportunities for job creation within their communities - opportunities to keep local graduates in the State - is much greater.

    Furthermore, our proposal would continue to provide special benefits for Upstate. Residential customers would see no reduction to their discounts for two years. Over the following three years, the discount would be gradually reduced but not eliminated. Revenue generated from NYPA’s sale of the Energize New York power would be used to provide a permanent discount to Upstate residential customers, and Upstate farmers that currently get a discount would continue receiving the same level of discount they receive today. Additionally, at least 35 percent of the new Energize New York power would be dedicated only for Upstate businesses. In these difficult times, it is critical that we make the most of our limited resources – our plan continues to provide benefits to Upstaters while providing an unprecedented opportunity for economic growth statewide. You don’t have to take my word that our approach is the best path forward. Business and labor groups, as well as editorial boards from every corner of the State have supported our approach:

    Newsday: “Gov. David A. Paterson is wisely refusing to sign the latest stopgap renewal passed by the legislature, because he has a better idea: Energize New York, a self-sustaining program that will reallocate 455 megawatts of NYPA's cheap hydropower, add it to an equal amount of market-rate power, and create a 910-megawatt program that will provide less expensive electricity to spur economic development across the state. … the Senate - including key upstaters - agrees with Paterson. Now the Assembly must get with the program and pass this bill, to light up jobs statewide.” (6/14/10)

    Syracuse Post Standard: “Short-term extenders do not provide the predictability businesses need to plan and prosper. A freeze on new businesses defeats the goal of luring new jobs to the state. Awarding benefits retroactively is just the opposite of planning ahead … However, lawmakers do have a remedy at hand that would create the needed predictability going forward for companies that need a hand in meeting their energy needs. The program has another catchy title — Energize New York. Not only would it open up some 910 megawatts of subsidized power from the New York Power Authority to businesses, it would offer seven-year contracts.” (7/2/10)

    The Buffalo News: “The measure would also preserve some benefits for residences, though they would decline over time. Again, though, those minimal savings were a relative waste of a valuable resource. Upstate is much better off devoting that power to a pool that can produce jobs than frittering it away on small breaks for thousands of residential customers.” (6/1/10)

    Binghamton Press and Sun: “…Albany is playing politics with a key business benefit — reduced power costs to employers. It's a game with the state's Power for Jobs program that Gov. David Paterson is trying to bring to an end by making the program permanent rather than renewable on an annual basis, which is what has occurred for the last five years of the 13-year program. Now Paterson needs some help. He's getting it from the Senate, which seems eager to go along with the governor's quest for permanency. The Assembly, however, appears to be balking, thereby leaving in limbo a key investment and job retention tool for New York.” (5/20/10)

    Now is exactly the time for such a program. The nationwide recession has taken a hard toll on New York families. More than 330,000 people lost their jobs between July 2008 and December 2009. Unemployment remains over 8 percent statewide, and over 800,000 New Yorkers are currently without work. Firms across the State, particularly in the manufacturing sector, are shedding jobs or, worse yet, permanently closing.

    Please call your local member of the Assembly to ask for their support of S.8065, the Energize New York bill. It is not too late to make a difference and put people back to work.

    If you look in the 3rd and 4th paragraphs it states how Speaker Sheldon Silver is the one holding it up. So it goes to show you that we weren't the only ones being hurt by his refusal to allow bills to go through. Something must be going on behind the scenes because Assemblyman Silver wasn't allowing any bills proposed by the Senate (or Governor) to be voted on. But it's us New Yorkers who are ultimately being hurt by it. I just wanted to throw this out there because this is something we need to think of now on how to get around it next session.

    One thought is to go to Assemblyman Lentol and Senator Sampson beforehand and ask them to take out the stipulations in their bills so it goes back to being all non-violent/non-sexual misdemeanors. If any of you have any thoughts please let me know.

    Like you said in your post the biggest obstacle people with a conviction in New York State face is themselves. There are so many out there yet there are very few who actively lobby. The people in just about every other state would be protesting left and right but in New York the residents are silent, which is why we still remain the only state without any type of sealing or expungement options for misdemeanors or felonies.

    This is something we can help ourselves on and that goes for you too macrylinda. Please stay active on the board and when the time comes for the legislative session to start up again then write and call all the important representatives. Don't disappear like so many users, because then we have to start from scratch.

    When December comes, we all need to band together and get as many people as possible to demand New Yore State adapts to modern times, because this is getting ridiculous.

    yes welcome aboard. if someone can think of an idea where we can open an escrow account, and raise a million dollars or so. considering there well over 3 million people with new york misdemeanors and even more with non-violent felonies. if each person donated $25.00 or so we can hire the best lobbying firm. even if a million people donated that would be 50 million. there has to be more people involved let build a war chest.

    There is going to be a fundraiser at a private home for senator sampson where you can talk to him and advocate this bill and show your support. Donations start at $250.00 to attend.
    It is on sunday august 15 on long island. At least 10 people from this site need to come and say you saw it on this website.

    This is outstanding sealing. This is my language with well over 3 million people convicted of a misdemeanor alone and many more with a felonies, now please keep in mund absolutely no violent felonies will be included in any bill. i will go there should be atleast a hundred people willing to go where are the over 3 million people with that many voters these legislators would move quicker. more and more are adding up everyday with da offices less likely to make pleas below a misdemenaor.

    this is a great opportunity to meet the majority leader whois the primary sponsor of this bill. since it is at a private home we can all speak one on one to senator, and the donation is low if you mention this website.
    we can all tell him our story in private and tell him how important it will be for us to reach our potential without barriers. Senator is a wondeful human being and if the democrats win in november i feel strongly he will get this through and perhaps add more to it.

    please everyone reading this come, and you still can remain anomynous at the fundraiser. people from allover with many issues will be there. There will be food as well. this is not an advertised fundraiser.

    Hello, I called to make a reservation and there's a correction:

    The fundraiser is on Saturday August 14, 2010.

    It'll start at 4 PM and go to about 9 PM.

    Now the minimum donation to get a ticket is $250. And I know this isn't cheap. However it is well worth it. Because not only is Senator Sampson going to be there but a couple other state senators will be there as well. So we'll all be able to group together and show our might if we get a bunch of people to go. But if we only have 2-3 people representing our cause, while that's still better than nothing, it's not going to leave a lasting impression.

    And users on here like "Once Upon a Time" who were eliminated for qualification by the revisions on this bill back in March, you should definitely go and explain your side of the story. Let them know why "endangering the welfare of a child" should be on the list of included offenses. This is your time to speak up or forever hold your peace.

    Also for those of you who don't want to pay because you absolutely can't go on that date... you still have no excuse. Because if you pay for a ticket and you let Charlene know that you can't make it, she'll arrange a short private meeting between you and Senator Sampson at his office... at a time that's convenient for you. And for those of you out of state (I'm sure a private call can be arranged).

    So there's really no reason you can have for not going for this. And if you don't then you can never complain when New York continues to be the only state to not offer any type of conviction relief. I'm speaking to those people who were convicted of non-violent/non-sexual felonies as well. This is also your chance to ask for your offenses to be included in this bill. They're going to be very open-minded at this event and willing to listen to new ideas. And this way you'll get an honest and direct response.

    Everyone please call Charlene immediately at (917) 548-3997 and reserve your spot. Let her know you saw it on this forum and that you are in favor of Senator Sampson's bill # S1708. If we make a good showing we can really hit the ground running this next session, which is really only 4 months away now, so it's almost here. Let's make our bill the top priority! And let's make it include all non-violent/non-sexual misdemeanors and even at least some non-violent/non-sexual felonies!

    I ask all the users to please buy this ticket. This is the real deal and what we really need to do! You know I wouldn't vouch for something that wouldn't be worth it. But this is the best thing we can possibly do! Thank you all!


    * - Also those of you in New York State's District 11, please don't vote to reelect Frank Padavan this November. Instead vote for Tony Avella because he's a big human rights guy and is in favor of sealing/expungement being offered in New York. Spread the word!

    Come on everyone lets show them we have at least ten people. We need to have our voice heard. In actuality a 1000 people would be a good number to lobby.
