Statutory Rape

My question involves criminal law for the state of: Georgia
Hello,
I was 12 or 13 when I first had consensual sex with a guy that was 18 or 19 at the time. We have been continuing having sex for going on 4 years now. When I was 14, I became pregnant with the same guy (he was 21 at the time). I had the baby at 15 years old. I am now 16; the baby is 6 months. Her father has not paid child support or helped in anyway. My mom recently called the cops on him and I was wondering what he would be charged with, and how long might he have to serve?

He could be charged with stat rape or child molestation. Its anyone's guess as to how long he could get in lock up, and he would be forced to pay child support once paternity testng is done.

On the plus side, all of those other children out there that come here to ask how they can "be" with their adult boyfriends just got a wake up call.

So, you are 16... have a child... the boy who has had sex with you since before you had any secondary female characteristics has abandoned you and the child... and now you have to chase him for support.

How is your school going? Do you have a college plan?

And yes sir, I have an extremely supportive family, and they all have agreed to help in any way they can to help me further my education. I am a senior in high school, and I am a year ahead of my class. I attend a school, called the Performace Learning Center, which helps students like me. It has a flexible schedule for mothers furthering their education. After I plan on going on to college. Thank you for your concern.

Aside from whatever charge he gets - Statutory Rape or Child Molestation - he will likely also be on the Sex Offender Registry for the rest of his life.

Personally, I would love to see you talk to groups of your peers and tell them how hard it is to raise a child when you are still very young yourself. Maybe you could make a difference to a few thinking of having sex....

He won't. But that's what happens when you commit a crime.

You can pursue him in Family Court and go after him for support, but you had better hope the police and the DA don't file on him for molesting you.

The obligation won't go away simply because he's sitting in the klink. It will just continue to accrue.

It will accrue while he is in prison. Then when he gets out and gets a job, he will be required to pay you child support and back child support. Now for the reality. Sex Offenders generally don't end up with good paying jobs, so the amount he will be ordered to pay you will be minimal at best. Likely around $100.00 or so a month. He will have sex offender counseling he has to pay for as well as living expenses. Plus fines, costs of the court etc.

What I am saying is, don't rely on any money he is ordered to pay. No matter how much he may want to, reality is that he just won't be able to make enough. The burden for supporting the baby will be totally on your shoulders. Very few bad decisions a teen makes are as expensive as the one to have sex with someone who is not ready for the responsibility's of life. Both fiscally and mentally.

It will pile up. You're not going to see any child support money until he gets out of prison. Even then, because he's going to have a statutory rape/child molestation conviction on his record, his prospects for employment much above minimum wage will be slim. The state will be able to garnish some of his wages, but not much. My guess is you're not going to see child support out of this guy for quite a while.

But because you won't be getting child support, you'll have increased eligibility for various state welfare programs. WIC, food stamps, etc.
