Quit On My First Day - Do I Get Paid
I worked one day in a preschool in Jefferson County Colorado. It was so discusting and unprofessional that I quit on my first day. (they didn't even have a functional bathroom for emplyees or a breakroom and the poor kids were crawling on nasty floors)
I signed a probation form stating I'd only be paid $9.50 per hour the first 90 days.
I worked 8 hours on November 11th, took a 15 minute lunch (I assume 30 mins will be taken out) and didn't get any break time.
The director is ignoring my phone calls. I've called about 4 times this week and emailed her, walked in and called previously. She is never available when I call so I have left messages for her through answering machine and through workers leaving my number and address asking her to mail the check. Never has she tried to contact me back.
Am I legally entitled to be paid for that one day? If so, what is the time frame, if any, that the buisness has to pay me?
What steps should I take to get the money if I am entitled to it?
I am open to any suggestions or tips and would greatly appriciate any and all help!

Yes, you are legally entitled to be paid for the day you worked. Since you quit, the pay is due on what would have been the next regular payday if you had remained at work. We don't know what the regular pay period would be, but in CO it can be as much as 30 days (or a calendar month) with pay due within 10 days after the close of the pay period.
Under Federal law, breaks of less than 20 minutes must be paid, so no, they cannot deduct 30 minutes for a 15 minute break.
You can contact the CO DOL http://www.coworkforce.com/lab/wage.asp if you are not paid within the appropriate time frame.

I actually recieved the check today in the mail. However, it was for 50.12.
Without taxes it would be 71.25. For Arvada Colorado does it sound about right to take out 30% from a paycheck for taxes??
CO state tax is 4.63% which might actually only be federal?? I don't know anything about income tax...

Didn't you get a pay stub with that check detailing the deductions? Colorado law requires the employer provide you with deduction information.

Sorry, I haven't had employees in Colorado since 1999. I have no idea what the tax rate is. Mlane might have some idea if he wanders by. It doesn't sound outrageous, depending on how many exemptions you have.

Especially if the income tax calc used the daily rate table (which is possible and would be a legal calculation).
I still want to know about a pay stub, though.

Sounds like the right amount to me.
Last time I received a paycheck, deductions for FICA, etc., plus state taxed equaled to roughly 28%. Your state income tax is a little higher than mine.

You can't go by what someone else's calculations are. There are many factors, including YOUR W-4 status and the calculation table used, what wage bracket the employee is in based on taxable wages, and any possible pre-tax deductions.

Patty, I am sorry about that one. I forgot that people do have different amounts withheld based on the number of dependents.

Good to know! I did recieve a check but only for the $50 rather than the full $71.25. I assumed they witheld taxes so I was waiting for a W2. I never got one.
I'm planning on going in tonight or tomorrow to ask about the missing $20.
