Distribution of Marijuana at School
My question involves criminal law for the state of: Texas
I sold some joints to a girl in my school and she got caught with them and blamed it on me. i got called into the office and searched and when nothing was found they searched my phone and found text messages to that same girl about selling it to her. but the messages didnt say specifically marijuna. the messages said stuff like "do you have the money" or "do you want 2 or 3" etc. it never said anything about marijuana. and the girl gave me 5$ and they found the 5 dollar bill on me. what should i do. they have not busted me yet and they are putting a case together. please i need help NOW. They also said that they had 2 witnesses. please help
Re: Distribution of Marijuana at School
Let your parents know what you did and that you need an attorney. Because sooner or later, the police are going to be questioning you and they'll piece it all together; And if you're a minor, they'll be doing this with your parents present.
Carrying, using, and/or selling drugs on school property is a SERIOUS offense and won't be taken lightly - Zero Tolerance!
Get an attorney.
Re: Distribution of Marijuana at School
yeah i already told my parents everything. they say its a class 5 felony is there any way it could be reduced??? i have a pretty good explanation for the text messages which is really the only evidence. either than the 5 dollar bill but i could have gotten that from anywhere. either than that its a he said/she said situation. and i have come up with a preeeeeeeety good cover story. i have not admitted to the crime. i already have a lawyer and she says to keep my mouth shut.

You have to stop thinking you can talk your way out of this. The EVIDENCE is a series of eye witnesses and THEN the evidence of your phone and the money.
Your LAWYER will tell you that a "cover story" in open court is perjury... a felony all by itself.
I recommend against lying to a judge in open court.
I agree. Keep your mouth shut... completely.
