You can sue.
Checks in payment of a bill or other legal obligation are civil matters. There is no criminal recourse.
You can wait a while and when they think that they don't have to worry about those checks, because they were presented and bounced, you can put them through again. Just tell your bank to redeposit them. It has worked for me.
Is the person writing the checks a principal of the company? Do they know that the checks are going to bounce?
If it's you, I suggest that you stop until your employers fund their account. Granted, they may fire you.
The person writing the checks is an agent for a company, I am sure they know the checks are going to bounce. the person always gives a reason for why it happened, but it has not stopped. I sent an email requesting to be payed in cash but it didn't happen. I am not the only one having the bounce check problem, everyone that works there has the same problem.
The company he is an agent for pays him then in return he is to pay us.
You were not specific. If we are talking about payroll checks, depending on the state and some other factors, issuing those checks could be a criminal offense. I would go talk to the office of the state attorney/district attorney.
If we're talking about payroll checks, the aggrieved employees can file wage claims.
Ok That helps, but the employer does pay all charges caused by his bad checks but it has caused the holding company's checking account to suffer credit wise as if the holding company is bouncing checks even though it is cause from payroll check to bounce.
Is there anyway I can bring charges on this person writing the bad checks. He has been doing this for a couple of years and his bank has done nothing to stop him.
You represent the holding company?
Yes I do.....
Another one of his checks just bounced.... Again....
